Allahabad HC: Gyanvapi Vyasji Basement Worship Unrestricted, Preservation Ordered, Next Hearing on Feb 6

Varanasi: In Varanasi, Uttar Pradesh, a significant development occurred in the Gyanvapi Vyasji Tehkhana worship matter at the Allahabad High Court. The court rejected the Muslim party's plea to ban worship in the basement, issuing a reprimand on January 31. Despite the appeal against the District Judge's order permitting worship, the court refused to prohibit it. The High Court instructed the UP government to safeguard the site without allowing any damage or construction. The next hearing is scheduled for February 6 at 2 pm. The Muslim side plans to challenge the January 17 order during the upcoming proceedings.

 

In the ongoing Gyanvapi case, Senior advocate Syed Farman Ahmed Naqvi presented the mosque side's case, while Vishnu Shankar Jain, representing the Hindu side, opposed it. The court has maintained that worship can continue in the Vyasji basement, emphasizing the preservation of the site by the UP government. The Muslim party plans to challenge the January 17 order in the next hearing.

 

The District Judge appointed the DM Varanasi as the receiver, responsible for Vyasji basement since January 17. The court ordered the Advocate General of UP to address law and order concerns and directed the DM Varanasi to ensure security arrangements. Despite worship in the Vyasji basement, the court has sought detailed information from the UP government regarding the arrangements.

 

In response to the Varanasi District Judge's January 31 order, the Kashi Vishwanath Temple Trust was directed to appoint a priest for puja in the Vyasji basement. The Masjid Committee opposed this in the Supreme Court, which redirected them to the Allahabad High Court. The mosque side urgently appealed to the High Court, seeking a stay on the worship order and indicating a challenge to the January 17 order.

 

During the Allahabad High Court hearing, the Muslim side's lawyer expressed objections to the January 31 order and indicated a challenge to the January 17 order as well. The court questioned the maintainability of the application, pointing out that the January 31 order is a continuation of the DM's receiver appointment on January 17. The Mosque Committee's lawyers are presenting arguments on this matter.
