The Supreme Court has said the issue of menstrual leave policy should be examined by the government rather than mandated by the court.

New Delhi: The Supreme Court has refused to entertain a plea seeking to make provision of leave for all working women and girl students across the country. On the case being brought to the fore, CJI Justice Suryakant commented that if a company is giving leave during its periods on its own, then it is a very good thing.

 

He further said that as soon as you implement it strictly as a law, then other aspects of it will also have to be taken care of. Now it may be that women have difficulty in getting jobs. They should not be kept in government jobs, judiciary or other jobs.

 

He said that his career should be ruined. In such a situation, they should be told to stay at home. Apart from this, the CJI told the petitioner that you have already put your point before the Union Ministry of Women and Child Development. The government should talk to all the stakeholders and consider making a policy.

 

In fact, in the petition filed in the Supreme Court, it was said that leave is available for pregnancy, but not for menstruation. Some states and companies have made a provision of 2 days of leave in a month. In such a situation, the Supreme Court should direct all the states to make such rules.
